Terms and Conditions of the natto.pl online store

I. Definitions

Seller / Service Provider – “Ton Color Marek Kołodziejski”, ul. Ludowa 5C, 65-742 Zielona Góra, REGON 977909142, NIP 9291083477, e-mail: info@natto.pl, tel.: +48 601 161 199.

Store / Service – https://natto.pl. Customer – a natural person (including a Consumer and an Entrepreneur with consumer rights), a legal person, or an organizational unit placing an Order. Consumer – Art. 221 of the Civil Code; Entrepreneur-Consumer – Art. 385⁵ of the Civil Code. Goods – physical products, including fresh natto and dietary supplements. Sales Agreement – a distance contract in accordance with the Civil Code and the Consumer Rights Act. Personal pickup – at the Seller’s premises.

II. General Provisions

These Terms and Conditions define the rules for using the Store, placing Orders, and concluding Agreements.
The Store sells only physical Goods. A browser with JavaScript enabled is required. Delivery of unlawful content is prohibited.
These provisions do not infringe upon Consumer rights.
Product pages provide: composition, net weight, country of origin, storage conditions, best before date and allergens in accordance with Regulation (EU) No 1169/2011.
All supplements are registered with GIS; the Seller holds registration numbers. Dietary supplements do not replace a varied diet and do not possess medicinal properties.

III. Placing Orders

Orders can be placed as a guest or after creating an account.
Process: selection → cart → data → acceptance of Terms and Conditions → submission.
The agreement is concluded when the Customer receives confirmation of order acceptance for fulfillment by the Seller.
The Customer is responsible for the accuracy of the data.

IV. Prices and Payments

Gross prices in PLN (with VAT).
Payment: bank transfer, quick payments, card, or cash on personal pickup.
Delivery costs are visible in the cart. No wholesale sales.

V. Delivery and Collection

Delivery in Poland by courier or to pickup points.
Fresh natto requires 7–10°C; shipped in thermal packaging.
The Seller applies HACCP and is responsible for quality until delivery.
The Customer collects the shipment immediately and stores it according to the label.
No liability for quality deterioration after proper delivery and improper storage.
Order fulfillment within 30 days. Personal pickup during business hours; payment by cash or card.

VI. Withdrawal from the contract

Consumers and Entrepreneur-Consumers may withdraw within 14 days, with exceptions:

Perishable goods or goods with a short shelf life (fresh natto).
Goods in sealed packaging, if opened for hygiene reasons (e.g., opened supplements).

For other goods, withdrawal via e-mail info@natto.pl or by post. Model withdrawal form in Appendix A. Return of goods within 14 days. Refund of funds using the same payment method within 14 days of receiving the declaration; the Seller may withhold the refund until the goods are received. The Customer bears the cost of return shipping. In case of return, the Seller refunds the cost of the cheapest offered delivery.

VII. Complaints

The Seller is responsible for the conformity of the goods with the contract.
Complaints: info@natto.pl or the registered office address.
For efficient processing of fresh product complaints, the Seller may request photos, batch number, and delivery/pickup date.
Recommendation: for fresh natto, report quality issues within 24 hours of receipt. Failure to report within this time does not exclude Consumer rights.
Response within 14 days; no response means the Consumer’s complaint is accepted.

VIII. Personal Data

The data controller is the Seller. Data processing rules are defined in the Privacy Policy. Data is processed to the extent necessary for order fulfillment, account management, payments, and contact.

IX. Reviews

Only Customers who have made a purchase may add reviews. Content that is unlawful or unrelated to the product may be removed.

X. Liability

No liability for service interruptions due to force majeure or customer-side failures. In relations with Customers who are not Consumers, liability is limited to the Order value.

XII. Dispute Resolution

Assistance: consumer ombudsman, UOKiK mediation, ODR platform: ec.europa.eu/consumers/odr. Contact: info@natto.pl.

XIII. Governing Law

Polish law. For the Consumer, the competent court is according to general provisions; for others – the court competent for the Seller’s registered office.

XIV. Amendments to the Terms and Conditions

Amendments due to important legal or organizational reasons. They are effective from the date of publication and do not affect agreements concluded earlier.
